A. Legal Notices for the Use of Digital Properties

These LEGAL NOTICES govern your use of all digital properties of Arctic Leopard Electric Technology Co., Ltd. and its global subsidiaries (collectively “Arctic Leopard Group”, “we”, “us”, or “our”), including but not limited to websites, companion mobile applications, and connected vehicle interfaces (“Digital Properties”). To the extent applicable, terms pursuant to Sections B through H apply additionally.

1. Intellectual Property

All visible and non-visible components of the Digital Properties, especially software, application code, firmware, telemetry interfaces, videos, images, graphics, audio, and technical text (collectively “Content”), as well as their arrangement, are protected under international intellectual property and copyright laws. All rights are reserved. No commercial reproduction, distribution, alteration, extraction, or transfer to third parties is permitted without express written authorization from Arctic Leopard. All brand emblems, logotypes, model designations (such as E-Moto, Cheetah, and Leopard series), and corporate nameplates are protected registered trademarks of Arctic Leopard Electric Technology.

2. Liability Disclaimer

While our Digital Properties are developed and maintained with extreme diligence, Arctic Leopard cannot guarantee that all contained data, specifications, service updates, or firmware releases are continuously error-free, exhaustive, or immediately updated across every territory.

3. Vehicles and Performance Specifications

Motorcycles, battery packs, and performance hardware depicted across Digital Properties may vary in details from mass-production units. Certain media showcases optional equipment, competition-tuned components, or colored frame options available at additional cost. Published figures regarding range (e.g., test ranges at constant speeds), top speed, peak power (kW / HP), motor torque, and weight reflect series baseline condition under controlled factory parameters; actual real-world output may vary based on rider weight, riding style, terrain, ambient temperature, battery state-of-health, and tire pressure. Manufacturer Suggested Retail Price (MSRP) excludes pre-delivery inspection, licensing, registration, domestic transport fees, local taxes, and dealer installation charges. An “Authorized Dealer” or “Distributor” is an officially accredited Arctic Leopard partner.

4. Links to Third-Party Services

Digital Properties may provide connections or hyperlinks to third-party platforms (including third-party map providers, charging network locators, and payment gateways). Arctic Leopard assumes no responsibility or liability for content, availability, security, or terms governing external sites.

5. The “Arctic Leopard” Brand

“Arctic Leopard” designates Arctic Leopard Electric Technology Co., Ltd. as the exclusive owner and worldwide manufacturer of high-performance electric off-road powertrains, proprietary clutches, and complete electric motorcycles. Third-party aftermarket components or unauthorized replica products sold without direct endorsement are in no way affiliated with the Arctic Leopard Group.

B. Registration and Management of User Accounts

Certain connected services, remote motorcycle diagnostics, NFC keycard pairing, and ride-tracking features require registration of a personal account (“Account”) via the Arctic Leopard App or web portal. You must be at least 16 years of age (or the legal age of majority in your jurisdiction) to open an Account; minors must have verified legal guardian consent.

You are responsible for supplying truthful registration details and safeguarding your access credentials. Arctic Leopard must be notified immediately of any suspected unauthorized access or compromise of your security credentials.

C. General Terms of Service & Connected Vehicle Data

1. Telemetry and Vehicle Usage Data

When pairing your Arctic Leopard motorcycle via the integrated telemetry control unit (TCU), Bluetooth, or NFC cockpit module, machine status parameters—including battery temperature, cell balancing, voltage, controller current, wheel speed, fault codes, and throttle inputs (collectively “Vehicle Data”)—are transmitted to deliver:

• Live cockpit data, customizable riding maps (e.g., Enduro, MX, Trial, Rally, Novice), and performance analytics;
• Over-the-Air (OTA) firmware updates, battery management system (BMS) calibrations, and safety service notifications;
• Anonymized telemetry optimization for electric powertrain, controller tuning, and battery longevity engineering.

2. Vehicle Transfer, Resale, and TCU Reset

If you loan, lease, or permanently sell your Arctic Leopard vehicle, you must execute a hardware/software unpair and factory reset via the Arctic Leopard App. This disconnects the Vehicle Identification Number (VIN) from your profile, halts historical data transmission, and ensures the subsequent owner can register their clean account.

3. User Conduct and Code Integrity

You agree not to reverse engineer, decompile, extract, or tamper with controller firmware, battery management software, or API endpoints of Arctic Leopard. Bypassing factory voltage limits, speed limiters, or digital security certificates invalidates statutory warranties and constitutes a material violation of these Terms.

4. Inherent Operational Risk & Riding Responsibility

High-performance electric off-road riding carries inherent risks of property damage, physical injury, and death. Every operator must evaluate their personal skill level, terrain condition, and local legal requirements (including off-road registration and helmet laws). Arctic Leopard disclaims all liability for accidents resulting from excessive speed, hazardous maneuvers, unauthorized motor modifications, or failure to wear certified protective gear.

D & E. App Features: Ride Telemetry & Navigation

Rider Telemetry: Connected app features (including live torque delivery, regenerative braking adjustment, and clutch response curves) require compatible mobile hardware and active vehicle pairing.

Navigation & Trail Mapping: Third-party mapping solutions incorporated into the Arctic Leopard App provide directional guidance for convenience only. Field conditions, trail closures, weather, and physical obstacles supersede all digital navigation suggestions. Operating handheld screens or adjusting software parameters while operating the motorcycle is strictly prohibited.

F. Warranty, Maintenance & Technical Support

Factory-supported vehicles are delivered with a standard 12-Month Limited Manufacturer Warranty covering core powertrain components (Battery Pack, Electric Motor, and Inverter/Controller). Warranty claims require inspection by an Authorized Arctic Leopard Service Center or accredited distributor.

G & H. Brand Events, Competitions & Media Rights

Participation in Arctic Leopard sponsored track days, demo tours, or competitive rally events is voluntary and subject to mandatory safety inspections, track waivers, and verification of medical/accident insurance.

By participating in Arctic Leopard official events, you grant Arctic Leopard and its affiliates the irrevocable right to use event photographs, video captures, and telemetry achievements across official social channels, broadcasts, and marketing materials worldwide.

I. Regional Provisions & Governing Law

United States Users

SERVICES AND DIGITAL PROPERTIES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ARCTIC LEOPARD DISCLAIMS ALL INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES RESULTING FROM THE USE OF OUR VEHICLES OR SOFTWARE SERVICES.

European Union Users

Personal data collection conforms to the General Data Protection Regulation (GDPR) and EU connected vehicle data access guidelines. Statutory consumer rights remain unaffected.

Governing Law & Legal Venue

These Terms shall be construed and governed in accordance with the corporate seat laws of the respective Arctic Leopard contracting entity or designated international regional distributor, without regard to conflict of law principles.
